Why is Sam the family's legal guardian in the novel, No Kidding?

Sam is the family's legal guardian because his father is away wroking for long periods of time, and his mother, and alcoholic, has just been released from a Soberlife facility. Thus, Sam has been appointed guardian for both his mother and his younger brother, Ollie.
