Ebens and Nitz could not be retried because of a concept called double jeopardy. No defendant could be tried twice for the same crime. Although the men had not actually been tried, they had pled guilty to manslaughter. In effect, they were found guilty of the crime and they could not be prosecuted again in a criminal court of law for killing Vincent Chin.
