Popular votes were not yet part of the presidential election of 1800. (The public at large did not vote.) Under the system then in place, the person with the highest number of electoral votes became president; the person in second place became the vice president. Because both Jefferson and Burr received 73 votes, the vote went to the U.S. House of Representatives. There, each state had a single vote. On the thirty-sixth ballot, Jefferson received ten votes, Burr received four, and two states abstained. Thus, Jefferson became president and Burr became vice president.
