· Background: On April 3, 1962 the parents of ten students went to the New York State Court and insisted that the recitation of a prayer in their children's school was a violation of the fist amendment and was going against both their children's beliefs as well as their own. In public schools a voluntary non-denominational prayer was offered every day at the beginning of school. The children were not forced to say the prayer but many did because they believed they had to. The children were allowed to remain silent as well as be excused from the room during the recitation of the prayer
